Privacy Policy

The protection of your personal data is important to us. This privacy policy informs you about which data is processed when you visit this website, for what purpose this is done and what rights you have.

The controller responsible for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is:

NEWAVE Real Estate Consulting GmbH, Musterstraße 1, 80000 München, Germany

Represented by: Managing Director Harald Kams

Phone: +49 (0) 000 0000000

E-mail: info@newave-consulting.de

02Hosting

This website is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, USA (“Vercel”). When you access the website, information transmitted by your browser is automatically recorded in so-called server log files: IP address, date and time of the request, page or file accessed, volume of data transferred, referrer URL, browser type and version, and operating system.

Processing is based on Art. 6 (1) (f) GDPR. Our legitimate interest lies in the secure, stable and fast provision of the website. The log files are stored only for as long as is necessary for this purpose and are subsequently deleted.

We have concluded a data processing agreement with Vercel pursuant to Art. 28 GDPR. Insofar as data is transferred to the USA, the transfer is based on the standard contractual clauses of the EU Commission (Art. 46 (2) (c) GDPR). Further information can be found in Vercel’s privacy policy: https://vercel.com/legal/privacy-policy.

Transmission between your browser and our server is encrypted via HTTPS (TLS).

03Cookies and consent management

This website uses cookies and comparable technologies. Technically necessary cookies are required for the operation of the website and are set without consent (Section 25 (2) German Telecommunications Digital Services Data Protection Act (TDDDG)). All other cookies – in particular for web analytics – are only used with your express consent (Art. 6 (1) (a) GDPR, Section 25 (1) TDDDG).

To obtain and document your consent, we use the consent management tool Cookiebot provided by Usercentrics A/S, Havnegade 39, 1058 Copenhagen, Denmark. Cookiebot stores your consent decision in a cookie and, in doing so, processes your anonymised IP address, the date and time of consent and the URL accessed. The legal basis is Art. 6 (1) (c) GDPR in conjunction with our obligation to be able to demonstrate consent (Art. 7 (1) GDPR).

You can change or withdraw your consent at any time with effect for the future via the “Cookie settings” link in the footer of this website.

04Web analytics (PostHog)

If you have given your consent, we use the PostHog service provided by PostHog Inc., 2261 Market Street #4008, San Francisco, CA 94114, USA, to analyse the use of the website. We exclusively use PostHog’s EU hosting; data is processed on servers within the European Union (Frankfurt am Main).

PostHog collects pseudonymised usage data such as pages visited, clicks, time spent, approximate region of origin, device type, browser and operating system. The IP address is not stored permanently. No merging with other personal data – for example from the contact form – takes place.

The legal basis is your consent pursuant to Art. 6 (1) (a) GDPR and Section 25 (1) TDDDG. You can withdraw your consent at any time with effect for the future via the cookie settings. Further information: https://posthog.com/privacy.

05Contact form

If you send us an enquiry via the contact form, we process the data you enter (name, company, e-mail address, optionally telephone number, topic and message) exclusively for the purpose of handling and responding to your enquiry.

The form message is delivered to our mailbox via the e-mail service Resend provided by Resend Inc., 2261 Market Street #5039, San Francisco, CA 94114, USA. A data processing agreement is in place with Resend; the transfer to the USA is based on the standard contractual clauses of the EU Commission (Art. 46 (2) (c) GDPR).

The legal basis for processing is Art. 6 (1) (b) GDPR insofar as your enquiry is aimed at concluding a contract or serves the implementation of pre-contractual measures; otherwise Art. 6 (1) (f) GDPR on the basis of our legitimate interest in responding to enquiries addressed to us.

Your data will be deleted once your enquiry has been fully processed and no statutory retention obligations stand in the way.

06Appointment booking (Calendly)

Via the “Book a call” button on our contact page, you can arrange an initial call using the scheduling service Calendly provided by Calendly LLC, 271 17th Street NW, Suite 1000, Atlanta, GA 30363, USA.

For data protection reasons, the Calendly widget is only loaded once you actively click the button. No data is transferred to Calendly beforehand. By clicking, you consent to Calendly processing your IP address and technical data from your browser.

When making a booking, you transmit your name, e-mail address, the selected appointment and, optionally, further details directly to Calendly. The legal basis is Art. 6 (1) (a) GDPR (consent by clicking) and Art. 6 (1) (b) GDPR (implementation of pre-contractual measures). The transfer to the USA is based on the standard contractual clauses of the EU Commission. Further information: https://calendly.com/privacy.

07Fonts

This website uses the fonts Montserrat and Inter (Google Fonts). The font files are served locally from our server (integrated via next/font). No connection to Google servers is established when you access the website; no data is transmitted to Google.

08Your rights

With regard to the personal data concerning you, you have the following rights vis-à-vis us: right of access (Art. 15 GDPR), right to rectification (Art. 16 GDPR), right to erasure (Art. 17 GDPR), right to restriction of processing (Art. 18 GDPR), right to data portability (Art. 20 GDPR) and right to object to processing (Art. 21 GDPR).

You may withdraw any consent given at any time with effect for the future (Art. 7 (3) GDPR). The lawfulness of processing carried out up to the point of withdrawal remains unaffected.

To exercise your rights, an informal message to info@newave-consulting.de is sufficient.

You also have the right to lodge a complaint with a data protection supervisory authority regarding our processing of your personal data (Art. 77 GDPR), in particular with the supervisory authority of your habitual residence, your place of work or our registered office.

09Validity and amendments to this privacy policy

We reserve the right to amend this privacy policy so that it always complies with current legal requirements or to reflect changes to our services. The current version of the privacy policy then applies to your next visit.
